The terms of reference define the vision, objectives, scope and deliverables for the new project. Any risks, issues, planning assumptions and constraints are also identified.Appoint the project team: The project team is now ready to be appointed. Although a project manager may be appointed at any stage during the life of the project, the manager will ideally be appointed prior to recruiting the project team. The problem with this demand approach is that project feasibility and sustainability is affected because the demands led planning comes with vested interests not matched with an objective appraisal of projects. As a result, LAs invest in a fragmented portfolio of projects that are neither linked to the national plans nor to their own strategic plans.It is important therefore, that at the project identification/initiation stage, LAs choose projects from many alternative ideas or schemes that balance between local demands, strategic priorities, ongoing diagnostics, and research or baseline studies. It is important therefore that all many citizens and stakeholder groups get the chance to express the problems they experience and recommend solutions. Discussions, opinions and clarifications by the problem ââ¬Ëownersââ¬â¢ should be respected. The Manual on Community Participation has elaborate guidelines on how to conduct participatory needs assessment situation analysis. This ensures that ââ¬Ëownershipââ¬â¢ which is part of the project pre-feasibility is established from peopleââ¬â¢s needs and requirements. ii) Situation Analysis: Situation analysis concerns identifying the priority problems/ opportunities and their main causes.This is an i mportant factor because peopleââ¬â¢s desires and assessment of their needs, may be based on ââ¬Ësymptomsââ¬â¢ of an underlying or situational factor; addressing the symptoms will not solve the problems because the cause and effect have not been properly analysed. A properly planned intervention should therefore combine both needs analysis and situational analysis, based upon a correct and complete analysis of the existing situation. This involves analysing the present actual situation through various methods (transect walk, social mapping, gender analysis etc). The method chosen, can be ââ¬Ëproblem basedââ¬â¢ e. g. what are the prevalent problem situations or ââ¬Ëopportunity basedââ¬â¢, e. g. is there an opportunity to serve people with disability?After discussion and clarification by the ââ¬Ëproblem ownerââ¬â¢ or people affected by the problem, all opinions should be respected. The aim is to create a picture of reality. The existing situation should be in terpreted according to the views, needs, interests and activities of parties concerned. It is essential that all those involved accept the plans and are committed to implement them. A greater involvement of the beneficiaries and stakeholders in defining local problems, identifying solutions and implementing them ensures that the resulting programmes are more effective and sustainable. Participatory methods aim to create ownership and commitment among the involved parties.Once the projects are identified from needs situational assessments, the LA should consider the priority projects to be undertaken, and to do this, they must subject those needs/priorities to further review. This introduces the 3rd stage of the project cycle, project appraisal stage. VLIR (July 2002): Within the VLIR programme framework, problems, needs and interests of possible stakeholders are analysed and ideas for projects and other actions are identified and formulated in broad terms. This involves a study of the project context to obtain an idea of the relevance, the feasibility and sustainability of the proposal. A comparison of this information with the funding criteria will allow an assessment of the funding chances. Cant Get Away When Ligon moved to different states and changed jobs, Murphy was able to track her through malware he had placed on her computers and continue his attack. For over four years Ligon tried to ignore the messages by deleting them, but Murphy began making it appear that Ligon was the one sending the sexually explicit materials to her fellow workers. Murphy also had special email programs in order to hide his identity and he created the Anti Joelle Fan Club (AJFC) and repeatedly sent threatening emails from thisà alleged group. Ligon decided to start collecting the materials as evidence and went to the police who enlisted the help of the Northwest Cyber Crime Task Force, composed of the FBI, United States Secret Service, Internal Revenue Service, Seattle Police Department, and Washington State Patrol. The NWCCTF investigates Cyber-related violations including criminal computer intrusions, intellectual property theft, child pornography and internet fraud. She also managed to identify Murphy as the person harassing her and she obtained a court order barring contact. When Murphy emailed her, denying that he was harassingà her, he violated the court order. Murphy was indicted in April 2004 on 26 counts of sending harassing emails and other violations between May 2002 and April 2003. At first, Murphy pleaded innocent to all charges, but two months later and after a plea agreement was reached, he pleaded guilty to two of the violations. No Remorse From Murphy In court, Murphy told the Judge what he did was stupid, hurtful and just plain wrong. I was going through a bad patch in my life. I want to take my lumps and get on with life. In sentencing Murphy Judge Zilly noted that he was surprised that Murphy made no effort to indicate your remorse to the victim, to indicate you were sorry. Judge Zilly decided to impose 500 hours of community service instead of the 160 hours requested by the government. This trial date will address a government request for a preliminary injunction concerning Windows 98 as well as broader issues. The Sherman Anti-trust Act was passed in 1890. Then in 1914 the Clayton Act was passed to help with Anti-trust Cases. Anti-trust Lawsuits are few and far between, but recently cases against Microsoft are stacking up all around the world. In 1890 the Sherman Anti-trust Act was passed, but it was not until much later that it was enforced. The Act stated every contract, combination in the form of trust or otherwise, or conspiracy, in restraint of trade or commerce among the several States, or with foreign nations. The Sherman Anti-trust act was too vague and too difficult to enforce. The Clayton Act of 1914 helped this problem by making a more specific attack on monopolies. Things like predatory price-cutting, price discrimination, and acquisition of stock in a competing company with intent to destroy competition all became illegal. John D. Rockefeller is a prime example of monopolies in US History. By buying out competitors, or driving them out of business he obtained nearly 100 percent of the market in oil refining. The Standard Oil Company was eventually forced to dissolve into smaller companies after the case Standard Oil Company vs. United States, 221 U.S. 1 (1911). Before this case the Anti-trust Laws had not been put to much use, which was not to the benefit of consumers. Now the spotlight is on Microsoft Corporation, and their apparent attempt to take over the Internet browser market. Concerns aroused recently because of the expected release of Windows 98, which uses Microsoft Internet Explorer in almost every application it runs. The US government has seemingly acknowledged Microsofts monopoly of operating systems and let it go by because of lack of competition in the market. But now new issues are at stake, should Microsoft be allowed to expand its already almost monopoly into yet another field in the computer industry? With the incorporation of Microsoft Internet Explorer into the Microsoft operating system Windows 98, Netscape Communications Corporation felt vulnerable, and filed complaints with the Justice Department. Once the investigations were initiated, it seemed flocks of people jumped the bandwagon to attack the alleged Microsoft Corporation Monopoly. 20 State Attorney Generals and the District of Columbia, along with the Justice Department have filed against Microsoft Corporation. Japan has also filed an Antitrust Lawsuit against Microsoft. It seems that everywhere Microsoft is, there looms a bit of concern for the consumers and their futures. Currently 90 percent of the worlds personal computers run on Microsoft operating systems. The remaining ten percent of the industry is divided between Apples Macintosh, IBMs OS/2, and Unix. The federal and state antitrust regulators are arguing that Microsoft has illegally used the popularity of its operating systems to eliminate its competition in the software industry. Many economists feel that these lawsuits against Microsoft Corporation could be as revolutionary as those against Bell Telephone in 1984 and John D. Rockefellers Standard Oil Company in 1911. Microsoft Corporation however, disagrees, arguing that the changes being demanded by federal and state government will take months to perform and would cause the software to be useless. Microsoft clings strongly to their beliefs that Windows 98 cannot succeed without Internet Explorer. Such an operating system which would take many months (if not years) to develop and test would bear little, if any, resemblance to Windows 98 because Internet Explorer technologies are such a critical element of that product, Microsoft wrote. For a company such as Microsoft, where the company name is also the brand name, it is extremely important that the public views them in goodwill. This type of campaigning is known as image advertising, it is designed to encourage goodwill toward the company, rather than sales of their products. He is most famous for his transatlantic flight from New York to Paris. Lindbergh acquired great fame for doing ?good will? tours in Latin America. Other than politicians and war heroes no one has yet quite matched his fame. He was a genus when it came to aviation and mechanics. He advised the making and design of several planes from ones made of wood and wire to supersonic jets. He helped several countries and airlines by giving them advise on their air fleets. He wrote several documents of his journeys and of his life. Charles Lindbergh entered this world on February 4, 1902 in Detroit, Michigan. He grew up in Rapid Falls, Minnesota on a family farm. His father's name was Charles Augustus Lindbergh, Sr. He was a lawyer and a congressman for the state of Minnesota between the years of 1907 and 1917. His mother's name was Evangeling Land Lodge. As a child Lindbergh showed that he had a great deal of mechanical ability. When he was eighteen years old he began attending the University of Wisconsin. While at Wisconsin he majored in mechanical engineering. During his time at the university he paid more attention to the growing field of avaion than he did to his studies. In 1924 Charles Lindbergh enlisted in the United States Army so he could begin studying on how to be a fighter pilot. One year later he graduated from the Army flight training school that was held on both Brook's field and Kelly's field. He graduated as the number one pilot in his class. After that he bought his own airplane and for the next six years of his life he spent flying an airplane for Robertson Aircraft Corporation. The planes filled with mail he flew from St. Louis, Missouri to Chicago, Illinois. During this time he was also a barnstormer which is a stunt pilot that does stunts over fairs and other public gatherings. During this time he received a reputation of not only being a cautions pilot but a quite capable pilot as well. A New York City hotel owner named Raymond Orteig started the Orteig Prize. The Orteig Prize was a twenty five thousand dollars for the first man to fly across the Atlantic Ocean solo and without stopping in between. Many pilots were injured or even killed trying to win the Orteig Prize. Raymond Orteig started the competition in 1919 and Charles Lindbergh had begun to take interest in it in the year 1926. In 1927 when somebody had yet to win the Orteig Prize Lindbergh found nine St. Louis businessmen to sponsor him because he thought with the right plane he would have no problem flying across the Atlantic Ocean. The businessmen began to promote the flight. That right plane was known as the ?Sprit of St. Louis?. Ryan Aircraft Company in San Diego built the ?Sprit of St. Louis?. He gave the ?Spirit of St. Louis? a test drive from San Diego, California to New York, New York making one stop in St. Louis. That flight took twenty hours and twenty-one minutes setting a new transcontinieal re cord. Charles Lindbergh started his transatlantic flight in Roosevelt Field on Long Island; the time was seven fifty two a.m. He flew from Roosevelt Field to Le Bourget Airport in Paris. He landed at ten twenty two P.M. on May 21. It took him thirty-three and half-hours to fly across the Atlantic Ocean. He traveled three thousand six hundred miles until he finally reached Paris. At the airport one hundred thousand people gathered after hearing that he was sighted flying over Ireland. A few days later he flew to Croydon Airport in London. It was dark when he landed and there were not many people there to witness the landing. As a result of having few people there, there were no photographs taken. When he returned to America there were several photographers waiting to get a picture of him. The press began to give him nicknames such as ?Lucky Lindy? and the ?Lone Eagle?.
